01 — Overview

Plain language, real commitments

These Terms of Service ("Terms") govern your access to and use of the services provided by Waxush ("we", "us", "our"), including Waxush.com, the Viba platform, and any associated applications or tools (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

We have written these terms to be as clear as possible. If anything is confusing or seems unfair, please tell us. We are a small team building in public and we want to get this right.

02 — Eligibility

Who can use Waxush

You must be at least 16 years old to use our Services. By using Waxush, you confirm that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

You must be a human. Automated account creation or use of the Services by bots is not permitted without our prior written consent.

03 — Accounts

Your account is your responsibility

To access certain features, you will need to create an account. You agree to:

  • Provide accurate and complete information when you register
  • Keep your login credentials secure and confidential
  • Notify us immediately at security@waxush.com if you believe your account has been compromised
  • Take responsibility for all activity that occurs under your account

You may not share your account or allow others to access the Services through your credentials.

04 — Beta access

What it means to be a beta tester

Access to Waxush is currently provided as part of a closed beta programme. As a beta tester, you acknowledge and accept that:

  • The Services are provided in an early, pre-release state and may contain bugs, errors, or missing features
  • Features, functionality, and availability may change at any time without notice
  • Your feedback is valuable to us and may be used to improve the platform — you grant us a non-exclusive, royalty-free licence to use feedback you provide
  • Beta access may be revoked at our discretion, though we will try to give reasonable notice when possible
  • Data loss can occur; we recommend not storing critical information solely within the platform during beta

In return, we commit to being transparent with beta users about changes, treating your feedback seriously, and working to make Waxush something you are proud to use.

05 — Acceptable use

Use it well

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Upload, transmit, or distribute malware, viruses, or any other harmful code
  • Attempt to gain unauthorised access to any part of the Services or any connected systems
  • Harass, threaten, or harm other users or members of our team
  • Scrape, crawl, or extract data from the Services without our permission
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Use the Services to build a competing product without our consent

We reserve the right to investigate suspected violations and take appropriate action, including suspending or terminating access to the Services.

06 — Your content

What you build is yours

You retain ownership of any content, code, or projects you create using the Services ("Your Content"). By using Waxush, you grant us a limited, non-exclusive, worldwide licence to host, store, and display Your Content solely for the purpose of providing the Services to you.

You are responsible for Your Content. You confirm that you have the rights to any content you upload or create through the platform, and that it does not violate these Terms or applicable law.

We do not claim ownership over Your Content. We will not sell or share it with third parties except as described in our Privacy Policy.

07 — Our intellectual property

What belongs to Waxush

All elements of the Services not created by you — including the Waxush and Viba brand, platform design, underlying code, documentation, and educational content — are owned by Waxush and protected by intellectual property law.

We grant you a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose. You may not reproduce, modify, distribute, or create derivative works from our platform or content without written permission.

08 — Third parties

Links and integrations

The Services may contain links to, or integrate with, third-party services. These are governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

Our use of third-party service providers (such as hosting and email infrastructure) is described in our Privacy Policy.

09 — Disclaimers

The honest small print

The Services are provided "as is" and "as available", without warranties of any kind — express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. As a beta product, outages and data loss are possible and you use the Services at your own risk during this period.

10 — Limitation of liability

What we are and are not responsible for

To the maximum extent permitted by law, Waxush shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of data, profits, or goodwill.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of the amount you paid us in the 12 months preceding the claim, or €50.

Some jurisdictions do not allow limitation of liability for certain types of damages. Where this applies, our liability will be limited to the fullest extent permitted by applicable law.

11 — Termination

Ending the relationship

By you

You may stop using the Services at any time. To delete your account and associated data, contact us at hello@waxush.com.

By us

We may suspend or terminate your access to the Services if you violate these Terms, if we discontinue the Services, or if required by law. Where possible, we will give you reasonable notice before doing so.

Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination will do so, including disclaimers, liability limitations, and dispute resolution provisions.

12 — Changes to these terms

We will keep you informed

We may update these Terms from time to time. If we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

If you disagree with updated Terms, you should stop using the Services and contact us to close your account.
